I want to sell my house, but I've heard that I may owe "recapture" on it. What's this all about?

Since January 1990, most single-family mortgage loans made by New Hampshire Housing have been subject to a "recapture tax." However, to be subject to this federal tax you would have to:

  • Sell your home within the first nine years of ownership; and 
  • gain on the sale of the home; and
  • experience a substantial increase in your income.

Your chances of having to pay a recapture tax are limited because you have to meet all three criteria listed above to be subject to this tax.

The recapture tax is paid directly to the Internal Revenue Service (IRS) through IRS Form 8828
